SJ 1: WORKERS’ COMPENSATION FUND - 1998 Budget/Special Session

Sponsor: Joint Labor, Health & Social Services Interim Committee

Senate Joint Resolution 1 was identical to the 1997 SJ 2 (described above), with the exception of a minor amendment in the Senate allowing workers’ compensation funds to be used for debt service related to the fund.

This time, there was no significant opposition.

SJ 1 passed 28-2 in the Senate and 59-1 in the House (see below).

The proposed constitutional amendment will appear on the 1998 general election ballot with the following explanation:

"The adoption of this amendment would provide that funds paid in the workers’ compensation fund may only be expended as provided in the Workers’ Compensation Act and for debt service and for workplace safety as provided by law."

For the constitutional amendment to pass, it must win the approval of a majority of those voting in the general election, not just those voting on the amendment.

The two senators voting against SJ 1 were Sen. Rich Cathcart (D-S6, Carpenter) and Sen. Larry Gilbertz (R-S23, Gillette) . The representative voting against SJ 1 was Rep. John Hanes (R-H42, Cheyenne).
