SF 79: IMPLIED WARRANTY OF HABITABILITY - 1998 Budget/Special Session Sponsor: Sen. Greg Phillips (D-S15, Evanston) SF 79 was a follow-up to the unsuccessful 1997 landlord-tenant legislation (SF 46, described above). SF 79 took the approach of separating the numerous issues involved in landlord-tenant relations, and addressing them one at a time. The issue addressed in SF 79 was simple: The landlord shall warranty that the premises rented, and all areas used in connection with them in common with other tenants, are fit for habitation, and that the occupants shall not be subjected to any conditions that would be hazardous or detrimental to their life, health or safety. Proponents argued that this would be a positive first step toward improving landlord-tenant relations, while opponents continued to deny the need for legislative action in this area. SF 79 fell just short of the two-thirds vote needed to introduce a non-budget bill in a budget session, 19-9 (2 conflicts). The Joint Judiciary Interim Committee will be studying landlord-tenant legislation between the 1998 and 1999 sessions. The vote listed below is the Senate vote to introduce SF 79. A YES vote means the senator wished to consider legislation requiring landlords to provide habitable and safe rentals. A NO vote means the senator did not wish to consider such legislation.
