SF 60: ORDERS OF PROTECTION - 1998 Budget/Special Session

SF 60 proposed a change to the existing law governing temporary child custody during divorce proceedings.

Currently, upon application of either party to the divorce, the court may make an order concerning the care and custody of minor children of the parties. In doing so, the court is required to consider evidence of spouse abuse or child abuse as contrary to the best interest(s) of the child(ren).

SF 60 added language providing that the party applying for the order "shall notify the court of any known protection orders issued on behalf of the parties from any other court." It further provided that evidence of spouse abuse or child abuse "including orders of protection issued by any other court within or outside this state" should be considered as contrary to the minors’ interest.

After passing the Senate, 30-0, SF 60 was referred to the House Judiciary Committee, which also gave its unanimous approval. However, the bill died on General File in the House (was not brought up for debate).

SF 60 passed the Senate unanimously, 30-0. The vote listed below is the House Judiciary Committee vote, also unanimous (9-0).

A YES vote means the representative favored requiring courts to consider protection orders when making child custody decisions.
