SF 3: PUBLIC MEETINGS - DEFINITION - 1997 General Session

Wyoming's Open Meetings Law currently defines a "meeting" as, "...an assembly of at least a quorum of the governing body of an agency which has been called...for the purpose of discussion, deliberation, presentation of information or taking action regarding public business."

The governing body of an agency must give notice of its meetings and make them open to the public except for discussion of certain specified matters, such as personnel or litigation. SF 3 proposed to change this definition to exclude "...casual conversation between agency members, consultation with agency staff or normal day to day contact with citizens or constituents even when a quorum is present."

Proponents argued SF 3 was needed to address certain situations encountered by elected officials or administrators where they might find themselves together in a quorum, but not taking information or making decisions.

Opponents argued that the proposed change would allow decisionmakers to circumvent the Open Meetings Law, discussing information and making decisions under the guise of casual gatherings, and then simply ratifying these actions in public.

SF 3 passed the Senate, 23-7, but foundered in the House Corporations, Elections & Political Subdivisions Committee, where it died without a vote.

The vote listed below is the third reading (final passage) vote in the Senate.

A YES vote means the Senator favored amending the Open Meetings Law to allow informal gatherings of a quorum of an agency's governing body.

A NO vote means the Senator opposed amending the Open Meetings Law to allow such informal gatherings.
