HB 47: Prevailing Wage Amendments
2007 General Session

HB 47 would authorize a single statewide wage district for the purpose of calculating the prevailing wage on state-funded contracts. As introduced, it would have authorized the Department of Employment to investigate prevailing wage violations either upon receipt of a complaint of violation or upon its own volition. It would also provide a bid preference in the amount that is already statutorily defined to contractors who participate in the Department of Employment's prevailing wage survey.

Supporters of HB 47 noted that it would stabilize construction wages statewide, which would especially benefit highway construction projects and workers.

The House amended HB 47 to make the prevailing wage requirements apply only to projects that cost $50,000 or more, and they removed the Department of Employment's authority to investigate violations on its own volition. With these amendments, the House passed HB 47, 46-14.

The Senate amended HB 47 to apply to projects that cost $100,000 or more, and they reinstated the Department of Employment's authority to initiate investigations on its own volition. Thus amended, the Senate passed the bill 27-1 (2 excused, Senators Bob Peck (R-S26, Riverton) and Michael Von Flatern (R-S24, Gillette)).

The House did not concur with the Senate amendments. A conference committee clarified that the Department of Employment would have to have a reasonable suspicion of a violation before they could investigate. With this language, the bill passed both chambers and was signed by the governor.

The votes listed below are the House and Senate third reading (final passage) votes. A YES vote by a representative means the legislator supported using the same prevailing wage scale statewide on state-funded projects that cost $50,000 or more. A YES vote by a senator means the legislator supported using the same prevailing wage scale stateside on projects valued at $100,000 or more, and supported allowing the Department of Employment to investigate alleged violations upon their own volition. A NO vote means the legislator did not support the statewide wage district, or (in the case of representatives) that they did not support it without giving the Department of Employment expanded authority to investigate potential violations.
