         SF 5 defined certain communications between legislators and legislative staff as confidential, which will allow these communications to be kept secret unless the legislator waived the secrecy privilege.
         Specifically, communications between a legislator and legislative staff will be confidential if they relate to a request for research or advice, drafting of legislation or amendments, anything being considered by a legislative committee (not including what happens in public meetings), or development of the legislator's position on legislation.
         Confidentiality will also apply to communication on these same topics between a legislator and a contractor or consultant retained by the legislature (not including what happens in public meetings), and to private communications between a legislator and his or her constituents.
         The confidentiality provisions will apply to all documents and electronic records.
         Supporters of SF 5 said the confidentiality language in the bill simply represents what legislators already do, and the bill only puts into statute the Legislature's traditional method of operation.
         The Wyoming Press Association, the League of Women Voters, and the Equality State Policy Center all argued against SF 5, instead urging legislators to keep the public process as open to citizen participation as possible.
         The Senate passed SF 5 unanimously. The House passed SF 5, 36-22 (2 excused).
         Governor Freudenthal vetoed SF 5, but the House and Senate both voted to override the Governor's veto, so the bill became law.
         The votes listed below are the House and Senate third reading (final passage) votes, and the House and Senate votes to override the Governor's veto. A YES vote means the legislator wanted to declare that draft legislation and all communications regarding development of legislation would be confidential from the public. A NO vote means the legislator did not favor making development of legislation confidential.
