SF 161: Federal Mineral Revenues - Distribution

In 2000, the Legislature established caps on the amount of mineral revenue that would automatically flow into earmarked accounts. Each year, the first $200 million received by Wyoming from federal mineral royalties is distributed according to statutory formulas to various accounts including local governments, highways and schools. Any revenue above $200 million is divided between the school foundation account and the budget reserve account (one-third to two-thirds, respectively).
        
SF 161 would have changed the distribution of federal mineral royalties above the $200 million cap. The school foundation account share would have decreased to 10% of all revenue above the cap, and the budget reserve account's share would have increased to 90%.
        
The Legislative Service Office estimated that changing the distribution above the $200 million cap would result in about $80 million per year less for the school foundation account and the same amount more for the budget reserve account. Their estimation was projected three years into the future, for fiscal years 2006, 2007 and 2008.
        
Supporters of SF 161 noted that the school foundation account, which automatically receives deposits from both federal mineral royalties and state mineral severance taxes, is well funded and doesn't need as much automatic distribution as it currently receives. They favored making more federal mineral revenues available to the Legislature for other spending needs through the budget reserve account.
        
Opponents disliked the idea of reducing funding for the school foundation account, arguing that it would be more prudent to save money for future education needs by maintaining the automatic distributions as they are presently statutorily defined.
        
The Senate defeated SF 161 on third reading, 14-15 (1 excused).
