         SF 25 proposed an increase in the amount of state severance taxes that would automatically flow into the Wyoming Permanent Mineral Trust Fund (WPMTF).
         Now, the first one and one-half percent of all severance taxes that are collected in Wyoming go directly into the WPMTF, under the Wyoming Constitution (Article 15, Section 19). After the constitutional distribution, a certain amount is directed into the LUST program. Then, the next $155 million collected in severance taxes each year are directed into a number of accounts, including water development, local governments, highways and schools. Whenever the amount of severance taxes in any year exceeds the $155 million cap, the excess is deposited into the general fund and the budget reserve account.
         SF 25 increased the amount of severance tax deposited into the WPMTF before any other distributions were made. The amount of the additional deposit equaled two-thirds of the amount that was deposited from the constitutionally mandated one and one-half percent severance tax. After the additional severance tax was added to the WPMTF, distribution of the remaining severance taxes followed the same formulas as before.
         The Legislative Service Office estimated this would lead to an increased contribution to the WPMTF of $91.6 million in 2006, $90.9 million in 2007 and $93.7 million in 2008, with a corresponding decrease in deposits into the general fund and the budget reserve accounts each year.
         Proponents of SF 25 supported the permanent savings option offered by the WPMTF. Monies deposited into the WPMTF can never be removed, with the interest generated by the fund available for spending by the state every year. Supporters of SF 25 thought it was prudent to save for future generations through increased deposits to this permanent savings account.
         Others noted that significant mineral revenue already is earmarked for deposit into the WPMTF each year, and they favored saving money in a more flexible rainy day account, which could be used in future years when mineral revenues weren’t so high.
         The Senate passed SF 25, 20-10. The House initially defeated the bill, 30-28 (2 excused), because a majority of the House membership (31 votes) is required to pass a bill. The House then voted to reconsider the third reading vote, and on their second try, passed SF 25, 39-19 (2 excused).
         The votes listed below are the Senate and House third reading (final passage) votes. A YES vote means the legislator favored increasing the amount of state severance taxes that automatically flow into the WPMTF. A NO vote means the legislator did not want to increase the automatic deposit into the WPMTF.
