SF 52: Minerals - Property Tax Lien

The 2002 Legislature passed a bill establishing a process for the state to place liens on mineral production for delinquent payment of severance taxes. However, the bigger problem of counties being unable to lien mineral production for delinquent payment of property taxes was not addressed.
        
SF 52 filled that gap. It allowed counties to lien mineral production at any time, except that no lien could be enforced until the taxpayer's right to file and perfect an appeal concerning the tax delinquent property has expired.
        
The bill also provided that counties could, for good cause, release the lien and settle delinquent taxes, interest and penalties.
        
SF 52 passed the Senate 28-2 and the House 60-0.
        
The votes listed below are Third Reading (final passage) votes in the Senate and House.
        
A YES vote means the legislator supported allowing counties to place liens agains mineral production for delinquent property taxes.
        
A NO vote means the legislator did not support giving counties this ability.
