SF 14: Unemployment Insurance - Benefits Operation Amendments

         SF 14 contained a number of changes to Wyoming's unemployment insurance program. These included:
  1. eliminating the $300 cap on weekly benefits;
  2. allowing participation in an apprenticeship program up to eight weeks long during the benefit year, if the individual is not receiving wages or compensation during the program;
  3. changing the requirement that an individual claiming benefits must have earned 12 times the weekly benefit amount to eight times the weekly amount, unless the individual was discharged for misconduct;
  4. eliminating the 50% reduction of benefits if the recipient also receives Social Security or other retirement benefits to which the recipient contributed;
  5. adding a provision that weekly benefits will be reduced by any severance payments, termination allowances, or sick pay or earned vacation reimbursements the applicant receives;
  6. adding provisions regarding overpayments or penalties due on overpayments; and
  7. modifying the required one-week waiting period before benefits can begin: currently, claims filed between 2002 and 2004 do not have to meet the one-week waiting period requirement, and SF 14 extended the exemption to claims filed between 2002 and 2005.

         The unemployment insurance program is funded by employer payments made under federal law.
         SF 14 passed the Senate, 29-1.
         The House amended SF 14 to further extend the exemption from the one-week waiting period to apply to claims filed between 2002 and 2011. The House then passed SF 14, 58-2.
         The Senate did not concur with the changes made by the House to SF 14, so the bill went to a conference committee. The conference committee restored the one-week waiting period exemptions to those claims filed between 2002 and 2005, and the Senate and House then both adopted the final bill.
         The votes listed below are Third Reading (final passage) votes in the Senate and House.
         A YES vote means the legislator supported amending Wyoming's unemployment law as outlined above. In the case of representatives, it also means they favored extending the exemption from the one-week waiting period through 2011.
         A NO vote means the legislator did not favor amending the unemployment law.
