HB 53: Time of Day Limit to Telephone Solicitations

         HB 53 limited the hours of the day during which telephone solicitors could make telephone sales calls. As introduced, the bill prohibited phone solicitations before 8:00 a.m. and after 7:00 p.m.
         Proponents of HB 53 pointed out that many people do not want to be called in the evening, and they consider it an unpleasant invasion of privacy to receive unwanted telephone solicitations after the dinner hour.
         Opponents were mainly worried about being too restrictive, and noted that only one other state had an evening restriction as early as 7:00 p.m.
         The House amended the bill to allow telephone solicitation calls to be made until 9:00 p.m., and then passed the bill 54-4 (one excused, one conflict-of-interest).
         The Senate further amended HB 53 to prohibit calls after 8:00 p.m., and then passed the bill 29-0 (one excused). The House concurred with the Senate version of the bill, 55-3 (one excused, one conflict-of-interest).
         The votes listed below are the Third Reading (final passage) vote in the Senate and the House vote to concur with the Senate version.
         A YES vote means the legislator supported prohibiting telephone solicitation calls before 8:00 a.m. and after 8:00 p.m.
         A NO vote means the legislator did not support placing these time of day limitations on telephone solicitations.
