HB 45: Business Council - Repeal of Sunset

The Wyoming Business Council (WBC) was established in 1998. Parts of the former Commerce Department, a variety of advisory boards and the Department of Agriculture's promotion and marketing division were transferred to the new agency. Specifically, the functions and authorities of the old Commerce Divisions of Tourism and State Marketing, Economic and Community Development, and Science, Technology and Energy Authority, along with Agriculture Marketing were transferred.
        
In addition to the recombination of responsibilities, the Legislature gave the WBC a quasi-"public-private" structure with different pay scales and benefits than other state agencies. The Legislature set a sunset date of 2003 to evaluate the new structure and the agency's work.

During the 2002 session, an attempt was made to repeal the sunset date (HB 44). Rather than repeal the sunset date, the Legislature chose to extend it to 2008, on the grounds the evaluation should still take place, but the new ideas should be given more time.
        
HB 45 again proposed a repeal of the sunset date altogether. This time, the bill passed. The House vote was 45-15, and the Senate vote was 17-13.
        
Governor Freudenthal issued his first veto of the 2003 legislative session when the bill reached his desk. To override a veto requires a two-thirds vote by both the House and the Senate.
        
The House mustered just enough votes to override the Governor's veto, 40-19 (one excused), but the Senate voted not to override the veto, 12-18.
        
The first votes listed below are Third Reading (final passage) votes in the House and Senate, followed by the votes to override the Governor's veto.
        
On the Third Reading votes, a YES vote means the legislator supported repealing the sunset date for the Wyoming Business Council.
        
A NO vote means the legislator did not support repealing the sunset date.
