HB 163: Child Automobile Restraints

HB 163 modified existing Wyoming law regarding required car seats and booster seats for children.
        
Under current law, children must be properly secured in a child safety restraint system (car seat or booster seat) when traveling in a motor vehicle if they are under five years of age and weigh less than 40 pounds.
        
HB 163 increased both the age and weight specifications for children who must use child restraint systems. Under its provisions, all children under the age of nine years who weigh 80 pounds or less would need to be in a child's car or booster seat.
        
During House floor debate, an amendment was accepted to require that children in car or booster seats must be in a rear seat of the vehicle except in those vehicles that don't have a rear seat (i.e., pickup trucks).
        
Supporters of HB 163 provided information to show that regular seat belts do not fit children under 80 pounds properly, and serious injury or death can result if children of this size use them and are in an accident. They believed that the reduction in injury and death of children justified strengthening the regulations. They argued that the small financial investment of families in additional booster seats for older children would be more than offset by the reduction in pain and grief that accompanies serious injury to or death of a child.
        
Opponents of HB 163 argued that these decisions should be left to parents, and that the state should not force parents to do what the state thinks is best for children. They worried that some families might find it difficult to afford the additional booster seats required for their older children.
        
HB 163 passed the House 37-22 (one excused) and passed the Senate 21-9.

A YES vote means the legislator supported extending the required use of child restraint systems to older children.
        
A NO vote means the legislator did not support extending the required use of child restraint systems to older children.
