         In 1991, the Legislature enacted a severance tax break that exempted uranium production from all severance taxes as long as the price (figured by averaging three international commodity indexes) remains below $17/pound.
         This tax break was modified in 1995 (HB 118B) to a "sliding scale" exemption. Severance taxes are levied when the spot market price of a pound of uranium stays at $14 for at least six consecutive months.
         At that point, a 4% tax is phased in at a rate of 1% for each $2 increment in price - i.e., from $14.00 to $15.99, a 1% severance tax is imposed; from $16.00 to $17.99, a 2% tax - until at $20.00 or more, the full 4% is imposed.
         The 1998 Legislature extended the sliding scale exemption until March 31, 2003. HB 15 would further extend the exemption to March 31, 2009.
         According to the "Joint Report of Operations" published annually by the Department of Revenue - Mineral Tax Division and the Wyoming Oil and Gas Conservation Commission, the State of Wyoming lost the following amounts in severance tax revenues on uranium due to the severance tax exemption:
July 1, 2001 - June 30, 2002: $422,067
July 1, 2000 - June 30, 2001: $317,586
July 1, 1999 - June 30, 2000: $527,113

         The bill passed the House Revenue Committee 7-2. Committee members Roy Cohee (R-H35, Casper) and Lorna Johnson (D-H45, Laramie) voted against the bill. Committee members Pete Anderson (R-H10, Pine Bluffs), Kurt Bucholz (R-H 47, Saratoga), Pat Childers (R-H50, Cody), Tom Lockhart (R-H57, Casper), Saundra Meyer (D-H49, Evanston), Bill Thompson (D-H60, Green River) and Jane Wostenberg (R-H27, Worland) all voted in favor of the bill.
         HB 15 passed the House, 50-10.
         The Senate amended the bill to add uranium to the econometric model to evaluate mineral tax incentives, and appropriated $35,000 for that purpose.
         The Senate then passed HB 15, 25-5.
         The House did not concur with the change the Senate made to HB 15, but the conference committee chose to leave the Senate provision to add uranium to the econometric model in the bill, and the House and Senate both accepted the conference committee's final version of the bill.
         The votes listed below are Third Reading (final passage) votes in the House and Senate.
         A YES vote means the legislator supported extending the existing severance tax break on uranium until 2009.
         A NO vote means the legislator did not support the severance tax break extension.
