HB 118: Felony Driving Under the Influence

HB 118 would increase the penalty for driving a motor vehicle while under the influence of alcohol from a misdemeanor to a felony for repeat offenders.
        
As introduced, HB 118 specified that if a person were convicted of driving while under the influence five times within seven years, the fifth conviction would be a felony punishable by a fine of up to $10,000, imprisonment of up to five years, or both.
        
During House floor debate, the bill was amended to specify that a fourth conviction within five years would result in a felony conviction with the same penalties.
        
During Senate debate, the bill was further amended to require a substance abuse assessment, paid for by the offender, upon a third conviction. The Senate also reduced the term of imprisonment from a maximum of five years down to a maximum of two years.
        
Supporters pointed to statistics regarding the high number of traffic accidents and fatalities in Wyoming where alcohol is a contributing factor. They asserted that it is time for this state to get serious about getting drunk drivers off the road, and that seriously stiffening the penalties for drunk drivers is an essential step in the process.
        
Opponents were nonexistent in the House, which passed HB 118, 58-0 (with two excused). In the Senate, opponents apparently felt the penalties in the bill were too harsh. After reducing the maximum term of imprisonment, Senators passed the bill 24-5 (one excused).
        
The votes listed below are Third Reading (final passage) votes in the House and Senate.
        
A YES vote means the legislator supported increasing penalties for driving a motor vehicle while under the influence of alcohol to a felony for repeat offenders.
        
A NO vote means the legislator did not support increasing penalties for repeat drunk drivers.
