Wyoming has excellent campaign finance reporting laws - with one major flaw. Currently, all reporting takes place after the election. Wyoming is the only state that does not require some form of pre-election reporting of campaign contributions, so that voters can see where candidates are getting their money before the voters cast their ballots.
SF 32 embodied the third attempt in three years to enact pre-election campaign finance reporting. A 2001 bill sponsored by Sen. Cale Case (R-S25, Lander) passed the Senate Corporations, Elections and Political Subdivisions unanimously, but was not brought up for debate on the Senate floor. In 2002, another Case bill failed introduction in the budget session by only one vote (in the budget session, non-budget items must get a two-thirds vote - 20 votes in the Senate - just to be considered).
SF 32 required candidates and political action committees to file a fully itemized statement of receipts at least seven days before any primary, general or special election, with information current to the 14th day before the election. Unsuccessful primary candidates would still file a complete report 10 days after the election; successful primary candidates would not have to file a post-election report until after the general or special election.
The bill also made provision for electronic filing of reports if the Secretary of State adopts rules allowing for electronic filing.
During the past couple of years, the principal argument against pre-election reporting was that it would be too burdensome to the candidates. However, since the two major party gubernatorial candidates in the 2002 election - along with other statewide and local candidates - voluntarily offered pre-election reporting, that argument now seems moot.
During Senate debate, the bill was amended to reduce the penalty for violations from a felony to a misdemeanor.
SF 32 passed the Senate, 24-6, and passed the House, 52-8.
