         HB 31 would have extended a 2003 bill that appropriated $192,055 to the Governor, to be conveyed under contract to the Joint Business Council of the Shoshone and Arapaho Indian Tribes on the Wind River Indian Reservation. HB 31 would have provided the same level of funding for the coming year.
         The Joint Business Council was to spend the money to address special education needs of Indian students through program enhancements, services for students at risk of failure in school and other services designed to improve student success.
         The Joint Business Council would report annually to the Governor and the Joint Education Interim Committee on how the money was spent and what impact it had on student performance.
         Supporters of HB 31 favored continuing to support special education programs that help Indian students overcome problems facing citizens of the Reservation, including extreme unemployment and poverty, and lack of job skills.
         As with last year's legislation, there was little opposition to the intent of the bill, although some legislators continued to express concern about the constitutionality of the bill. It is not constitutional for the state to give money to non-state schools, and schools operated by the Bureau of Indian Affairs are not state schools.
         This year, the appropriation for special education projects for Indian students on the Reservation was also included in HB 1, the main budget bill, within the overall Department of Education budget. When the proponents of HB 31 learned that funding for HB 31 was included in HB 1, most agreed that was a better funding route than renewal of a stand-alone bill every year.
         HB 31 failed the vote for introduction in the House, 30-28 (2 excused). For a non-budget bill to gain introduction in a budget session of the Legislature, it must receive a two-thirds majority on the vote for introduction, which in the House is 40 votes.
         The votes listed below are the votes for introduction in the House.
         A YES vote means the representative wanted to consider extending funding for special programs in Bureau of Indian Affairs schools on the Wind River Indian Reservation for another year. Some representatives, even though they preferred having the funding included in the general budget bill, wanted to keep HB 31 alive as a backup in case the funding was amended out of the Department of Education budget.
         A NO vote means the representative did not want to consider extending funding through HB 31 for another year, either because they disapproved of the proposal altogether or because they were satisfied with its inclusion in HB 1.
