         HB 187 codified existing common law rights of landowner's to convey conservation agreements by writing them into Wyoming statutes. HB 187 simplified, but did not significantly change, the landowner's rights to convey conservation easements on their property.
         Similar laws have been enacted in 47 other states.
         Proponents of HB 187 noted that the right to convey a conservation easement is a property right, and as such has been exercised by many landowners for years under common law. They maintained that codifying this property right into Wyoming statute would benefit property owners across the state by simplifying and clarifying the process. They noted that HB 187 would not change existing parameters of conservation easements, which are entirely voluntary agreements that offer landowners a way to obtain substantial value from their land without affecting current use of the property.
         Opponents of HB 187 cited concern over potential loss of future taxes, even though property with an attached conservation easement continues to be subject to the same property taxes as before. It was noted that once a conservation easement is conveyed, it becomes an intangible property interest and as such, constitutionally cannot be subject to property tax. Opponents also were very distrustful of the concept of unlimited duration in conservation easements, even though the bill stated that an easement could be otherwise designated if the involved parties so wished.
         HB 187 passed the House, 43-17.
         HB 187 failed Third Reading in the Senate, on a tie vote, 15-15.
         The votes listed below are Third Reading (final passage) votes in the House and Senate.
         A YES vote means the legislator supported codifying landowner rights to convey conservation agreements by including them in Wyoming statutes.
         A NO vote means the legislator opposed including these property rights in Wyoming statutes.
