HB 104: Payroll Check-Off Amendments

HB 104 would modify Wyoming statutes regarding direct deposits from payroll check-off programs. The proposed statutory change would codify into law what has been occurring in practice for the past twenty years or more.
        
Under current statute, the state auditor and payroll officers for employees of the Wyoming Department of Transportation (DoT), the University of Wyoming (UW) and Wyoming's community colleges may establish payroll check-off programs whereby automatic deductions are made from the employee's paycheck to pay for supplemental medical plans, disability plans, life insurance plans and annuities.
        
HB 104 would remove the DoT from this statute, because DoT employees are now included with other state agencies whose payrolls are handled directly by the state. UW and the community colleges maintain their own payroll offices.
        
For state agencies under the state payroll office, the state auditor has for many years included employee organizations such as the Wyoming Public Employees Association (WPEA) and charitable organizations such as The United Way as potential recipients of payroll check-off programs.
        
HB 104 would add employee organizations and nonprofit charitable organizations to the list of potential payroll check-off recipients for UW and the community colleges.
        
Supporters noted that this bill changed nothing, but simply clarified in statute what has been long standing practice. They noted that State Auditor Max Maxfield supported maintaining WPEA as a recipient of payroll check-offs, but believed the change proposed in HB 210 would prevent confusion with future state government administrations.
        
Opponents argued that there was no need to make this statutory change, and that it was appropriate to leave it to the State Auditor's discretion whether or not to include WPEA in the check-off program. Some opponents specifically did not want the WPEA included as a potential recipient of payroll check-off programs for state employees.
        
The House passed HB 104, 54-2 (4 excused).
        
The Senate Appropriations Committee defeated HB 104 with an unrecorded vote.
        
The votes listed below are the third reading votes in the House.
        
A YES vote means the legislator supported including employee organizations and charitable organizations as potential recipients of payroll check-off programs for state employees.
        
A NO vote means the legislator did not support including these changes.
