OUTCOME
SJR 3 passed the Senate and House by veto-proof margins. Governor Geringer allowed SJR 3 to become law without his signature. SJR 3 will be a statewide ballot measure to be voted on at the 2002 General Election.

SJ 3: Constitution Amendment Process

      SJ 3, another proposed constitutional amendment, stems from a dispute between the legislative and executive branches over whether constitutional resolutions must be signed by the governor before going to the voters on a general election ballot.
      The Legislature, which overwhelmingly approved SJ 3, argues this is a "separation of powers" issue.
      Legislators point to the constitutions of many other states which allow their state legislatures to send proposed constitutional amendments directly to the voters.
      The Legislature attempted to assert this power by legislative rule, but was overturned in 2000 by the Wyoming Supreme Court in a 3-2 decision.
      The decision upheld the executive branch interpretation of the Wyoming Constitution's current language, which requires all legislative bills and "resolutions" to go to the governor's desk for signature or veto (the governor also may allow legislative actions to become law without signature). Although Governor Geringer opposes SJ 3, he allowed the measure to proceed to the ballot without a veto.
      It will appear as Constitutional Amendment D on the November 2002 general election ballot, as follows:
      This amendment would provide that amendments to the Wyoming Constitution proposed by the Wyoming Legislature will be submitted to the electors of the state without prior presentment to the Governor for his approval or disapproval.
      SJ 3 passed the Senate unanimously and the House on a 55-3 vote. Dissenting votes in the House were: Reps. Tony Ross (R-H7, Cheyenne); Wayne Reese (D-H11, Cheyenne); and Phil Nicholas (R-H14, Laramie). Reps. Jane Wostenberg (R-H27, Worland) and Marlene Simons (R-H1, Beulah) were excused.
