HB 178: Coal Severance Taxes - Amendments
2002 Special/Budget Session
Sponsor: Rep. David Miller (R-H55, Riverton); co-sponsors Reps. Saundra Meyer (D-H49, Evanston), Bud Nelson (D-H48, Rock Springs), Frank Philp (R-H34, Shoshoni), Teense Willford (R- H49, Saratoga) and Sen. Bill Vasey (D-S11, Rawlins)
     
HB 178 proposed reducing the coal severance tax to the constitutionally-mandated minimum of 1.5% for underground coal mined from seams averaging less than 20 feet in thickness and "mined separately from any other production."
     
Supporters of the bill said it was offered in the hope of stimulating coal development outside the Powder River Basin.
     
Opponents pointed out that in addition to the obvious difficulties of administering this proposal, the bill flew in the face of the Legislature's recent tax incentive study (see section on Coal Severance Taxes).
     
Opponents also noted that the price differential between Powder River Basin coal and other coals is too great to be overcome by a severance tax break for the latter.
     
HB 178 easily won introduction in the House of Representatives, 47-13, but was killed in the House Revenue Committee when only three members voted to work on the bill.
     
(The three members were Reps. Jane Wostenberg [R-H27, Worland], Pete Anderson [R-H10, Pine Bluffs] and Nick Deegan [D-H53, Gillette].)
     
The vote shown below is the House of Representatives vote to introduce HB 178.
     
A YES vote means the representative wished to consider a severance tax break for coal mined from seams less than 20 feet thick.
     
A NO vote means the representative did not wish to consider the bill.
