HB 68: Methamphetamine – Endangering Children Before Birth

Sponsor: Rep. Elaine Harvey (R-H26, Lovell); co-sponsors Reps. Keith Gingery (R-H23, Jackson), Marty Martin (D-H48, Rock Springs), Kevin White (R-H45, Laramie) and Sens. Jim Anderson (R-S2, Glenrock), John Barrasso (R-S27, Casper), John Hastert (D-S13, Green River)

HB 68 would have extended the definition of criminal child endangerment to include prenatal exposure to the drug methamphetamine. As related to child protective services, the definition of a child would be extended to include newborn babies that had been exposed to methamphetamine before birth. Drug courts and state-supported treatment facilities would give priority to pregnant women charged with endangering children by prenatal exposure to methamphetamine.

Opponents of HB 68 worried that this action would frighten pregnant women who feared prosecution away from obtaining appropriate prenatal care. They argued that education and treatment programs are more effective in preventing methamphetamine abuse and its affects on children than the threat of criminal prosecution.

The House Judiciary Committee passed HB 68, 5-4. Representatives Deborah Alden (R-H3, Wheatland), Dan Dockstader (R-H21, Afton), Keith Gingery (R-H23, Jackson), Erin Mercer (R-H53, Gillette) and Monte Olsen (R-H22, Daniel) voted in favor of the bill, while Representatives George Bagby (D-H15, Rawlins), Edward Buchanan (R-H4, Torrington), Lisa Shepperson (R-H58, Casper) and Mary Throne (D-H11, Cheyenne) voted against it.

The House passed HB 68, 39-21. The Senate Labor, Health and Social Services Committee unanimously passed the bill, but it died on general file in the Senate without floor debate or a vote.

The votes listed below are the House third reading (final passage) votes. A YES vote means the representative wanted to extend the definition of criminal child endangerment to include prenatal exposure to the drug methamphetamine. A NO vote means the representative did not want to criminally prosecute pregnant women who used methamphetamine.
