HB 11: Subdivisions – Exemptions
2007 General Session

Sponsor: Joint Corporations, Elections and Political Subdivisions Interim Committee

HB 11 modified existing laws governing subdivision of county land by adding an additional requirement to the family exemption and by adding a new exemption. Under current law, subdivision requirements do not apply when a landowner gives or sells property to an immediate family member, as long as the recipient keeps the property for at least one year. HB 11 specified that the landowner would have to own the property for at least five years before this family exemption could be applied.

The bill also created a new exemption to county subdivision laws, to allow parcels of five acres or less to be created to establish unmanned communication facilities, compressor stations, metering stations, fiber optic booster stations, or other similar unmanned facilities.

The House Corporations, Elections and Political Subdivisions Committee passed HB 11, 7-2. Representatives David Miller (R-H55, Riverton) and Tom Walsh (R-H56, Casper) cast the two votes against the bill.

The Senate Corporations, Elections and Political Subdivisions Committee passed HB 11, 4-1, with Senator Charlie Scott (R-S30, Casper) casting the NO vote.

The full House passed HB 11, 47-13, and the Senate passed the bill, 28-0 (2 excused). The votes listed below are the House and Senate third reading (final passage) votes. A YES vote means the legislator wanted to change subdivision laws as described above. A NO vote means the legislator did not support these changes to subdivision law.
