HB 104: Harassment, Intimidation or Bullying Prohibition
2007 General Session

Sponsor: Rep. Kathy Davison (R-H20, Kemmerer); co-sponsors Reps. Edward Buchanan (R-H4, Torrington), Kevin White (R-H45, Laramie) and Sens. Pat Aullman (R-S16, Thayne), Stan Cooper (R-S14, Kemmerer), Kathryn Sessions (D-S7, Cheyenne)

HB 104 would have required school districts in Wyoming to establish policies to prohibit harassment, intimidation or bullying of any student on school property or at school sponsored events. The policy would have included a procedure for reporting incidents, and a requirement that school personnel report any incidents of which they are aware. Schools would have had to develop procedures for documentation of and response to reported incidents, and for notification of parents or guardians of involved students. Schools would also have had to develop strategies for protecting victims from additional harassment or retaliation, and for disciplining perpetrators.

Information related to reported incidents would have been kept confidential.

HB 104 received strong support from the House Education Committee, the full House, and the Senate Education Committee, passing both committee votes unanimously and passing the House on third reading, 54-4 (2 excused). But the Senate killed the bill on its first vote before the Senate Committee of the Whole, 10-18 (2 excused).

The votes listed below are the House third reading (final passage) and Senate Committee of the Whole votes. A YES vote means the legislator wanted to require school districts in Wyoming to have written policies prohibiting harassment, intimidation or bullying of students on school property. A NO vote means the legislator did not want to require school districts to have such a policy.
